Fedele — Customer Terms of Use

1. Who we are
Welcome to Fedele ("Fedele", "we", "our"). Fedele is a loyalty platform that allows you to earn and redeem rewards at participating businesses ("Merchants").
Important: Fedele itself does not sell products, deliver rewards, or fund prizes. Fedele exclusively provides the technology platform that connects you and the Merchants.
2. What this document covers
These Terms of Use ("Terms") apply when you use the Fedele customer app or the related website (the "App").
If you are a Merchant using Fedele to manage your loyalty programme, different terms apply.
By using the App, you fully accept these Terms. If you do not agree, do not use the App.
3. Your account
Registration
To use the App, you must create an account providing accurate and truthful information (name, email).
Security
- You are responsible for the security of your credentials
- Do not share your password with anyone
- Notify us immediately if you suspect unauthorised access
One account per person
Each person may have only one account. Multiple accounts may be closed without notice.
4. Age and minors
The App may also be used by minors, with the following conditions:
- If you are 14 years old or older: You can create and manage your account independently
- If you are under 14 years old: You must use the App with the consent and supervision of a parent or legal guardian
The parent/guardian who authorises the minor's use of the App:
- Is responsible for the minor's activity on the App
- Accepts these Terms on behalf of the minor
- May contact us to manage or delete the minor's account
We may request proof of parental consent. In the event of unauthorised use by a minor, we reserve the right to disable the account.
5. How rewards work
Earning points
- You accumulate points when you make purchases or interactions at participating Merchants
- Your personal barcode in the App identifies your account
- Points are assigned by the Merchant, not by Fedele
Redeeming rewards
- Available rewards are shown in the App
- To redeem, show the barcode to the Merchant
- Each reward may have specific terms, limits, expiry dates, or exclusions set by the Merchant
Important rules
- The barcode is personal and non-transferable
- Do not share, copy, alter, or automate your barcode
- Points and rewards have no monetary value and are not convertible into cash
- Suspicious or fraudulent activity may result in account suspension and loss of accumulated rewards
6. Your relationship with Merchants
It is important to understand that:
- Rewards are offered and funded by the Merchant, not by Fedele
- The Merchant decides the rules of their programme (eligibility, point value, reward availability)
- Any disputes about a reward (quality, availability, refusal to redeem) are between you and the Merchant
Fedele's role:
- We provide the technology platform
- We may facilitate communication between you and the Merchant
- We are not responsible for the Merchant's decisions
7. Prohibited conduct
By using the App, you agree not to:
- Create fake or multiple accounts
- Create fictitious transactions or fraudulently manipulate points
- Share, sell, or transfer your account or your rewards
- Attempt to reverse engineer, decompile, or alter the App
- Use bots, scripts, or automated tools
- Upload illegal, offensive content or content that infringes third-party rights
- Use the App for illegal purposes
Violations result in suspension or closure of the account without the right to a refund or recovery of rewards.
8. No payments through Fedele
Fedele does not process payments for products or services and does not hold funds for you or for Merchants. All financial transactions take place directly between you and the Merchant.
9. Intellectual property
Fedele's Rights
The App, its design, code, trademarks, and all content are the exclusive property of Fedele or its licensors.
Licence to you
We grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to use the App on your personal devices.
What you cannot do
- Copy, modify, or distribute the App
- Use Fedele trademarks without authorisation
- Remove copyright or proprietary notices
10. Apple Wallet
If you choose to add your loyalty card to Apple Wallet:
- This feature is provided by Apple Inc.
- Use is subject to Apple's terms
- Fedele is not responsible for issues related to Apple Wallet
11. Communications
From Fedele
We may send you:
- Service communications (mandatory): updates to the Terms, security issues, important changes
- Marketing communications (with your consent): news, promotions, new Merchants
Managing preferences
You can manage marketing communications:
- By disabling push notifications in your device settings
- By clicking "unsubscribe" in emails
- By contacting us at info@fedeleapp.com
12. Changes to the service
We may:
- Add or remove features
- Modify the interface or functionality
- Temporarily suspend the App for maintenance
We will endeavour to give reasonable notice for significant changes or planned downtime.
13. Warranties and liability
Disclaimer
The App is provided "as is" and "as available". To the maximum extent permitted by law:
- We do not guarantee that the App will function without interruptions or errors
- We do not guarantee the availability or quality of Merchant rewards
- We exclude all implied warranties
Limitation of liability
To the maximum extent permitted by Italian law:
- We are not liable for indirect, incidental, or consequential damages
- This includes: lost rewards, failed redemptions, loss of data, loss of opportunity
- Our total liability to you shall not exceed the greater of:
- EUR 50 (fifty euros)
- The amount you have paid us in the preceding 12 months
Exceptions
This limitation does not apply to:
- Damages caused by wilful misconduct or gross negligence
- Violations of your fundamental consumer rights under Italian law
- Personal injury caused by our negligence
14. Indemnification
You agree to indemnify Fedele from claims, damages, or expenses arising from:
- Your improper use of the App
- Your breach of these Terms
- Disputes with Merchants
15. Account closure
By you
You can stop using the App and delete your account at any time:
- From the App settings
- By contacting us at info@fedeleapp.com
By us
We may suspend or close your account in the event of:
- Breach of these Terms
- Fraudulent or suspicious activity
- Risk to the security of the service
Consequences
- You will lose access to the App and accumulated rewards
- Your personal data will be anonymised immediately (see Privacy Policy)
16. Changes to these Terms
We may update these Terms periodically. In the event of material changes:
- We will notify you through the App or email
- We will indicate the effective date
Continued use of the App after the changes means you accept the new Terms. If you do not agree, you can delete your account.
17. General provisions
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement
- Severability: If any clause is invalid, the others remain valid
- Assignment: You may not assign your rights; we may assign to group companies or acquirers
- Waiver: Not exercising a right does not mean waiving it
18. Governing law and jurisdiction
These Terms are governed by Italian law.
For any dispute:
- We first seek an amicable resolution by contacting us
- If necessary, the Court of Milan (Italy) shall have exclusive jurisdiction
Consumer rights
Nothing in these Terms limits the rights you are entitled to as a consumer under Italian and European law, including the right to bring proceedings in the court of your place of residence.
